FOR ALL SERVICES INCLUDING BUT NOT LIMITED TO PRIVATE VOICE, ACTING, PIANO LESSONS, DANCE & GROUP CLASSES, VOICE OVER, GUITAR AND CAREER COUNSELING.


Terms


1. Tuition:


● For Voice students and for Acting/Voiceover students, all initial lessons will be conducted by Evaluation and Placement Directors. Then you will be assigned instructors based on your interests.


● Half hour lessons range from $40-$100 and one hour lessons range from $75-$200 depending on which instructor you are training with. All lessons are subject to  a 2.9% processing fee.


● Lessons are to be booked online at: ThePrepNJ.com/book, ThePrepLA.com/book ThePrepNY.com/book. You select your lesson location, instructor, and time. All private lessons, summer camps, and group classes must be prepaid in full.  We require The Prep students to save a credit card on file for memberships, credit packages, and suite plans and that you authorize The Prep to charge the credit card on file upon the booking of the lesson(s). The Prep does not accept back payments or payment after services have been rendered. *If you choose to opt out of saving a card on file, you will only be able to book a la carte single lessons through the website, and are unable to book any lessons within 24 hours of the lesson time, regardless of time sensitive auditions, ect. 


2. Cancellation Policy:


The Professional Performance Prep enforces a 24 hour cancellation policy and REQUIRES A 24 HOUR NOTICE IF CANCELING A LESSON. In such instances, the lesson will be charged as if it were conducted. No rescheduling will be permitted for cancellations with less than 24 hours notice. There shall be no exceptions unless approved in the sole discretion of management. Under no circumstance shall an approved exception be considered approval for future occurrences of late cancellations. The Professional Performance Prep’s Payment system will no longer be refunding processing fees for canceled lessons starting 2023.

3. Private Lessons:


● Clients are expected to arrive on time for all scheduled sessions. If a client is more than fifteen (15) minutes late, the instructor reserves the right to consider the session a no-show and may leave the premises.In such cases, the session will be forfeited and may be subject to the studio’s cancellation or no-show policy, without refund or rescheduling.


● If studying with Jessi, Theresa, or any The Prep instructor, we have the right to charge you for any texts, calls, tasks etc. that occur outside of scheduled lesson time. This includes and is not limited to fixing resumes, reviewing tapes, reviewing headshots, etc. We will prorate the time taken at our rate; for example: $130 per hour. ie 5 min will be $10.80 outside of lessons. We suggest you set up a Facetime / conference call or ask your questions during your allotted lesson time.


● We charge a $25-$45 editing fee for self tapes and voice overs. There is an upcharge for rush edits.

● primary booking options for clients: 


1) Prep Membership: clients can buy lessons in bulk, ex: 4 packs and are charged on a recurring basis each month. Any unused lesson expire at the end of the month. Reschedules to the following month are permitted on a case by case basis.


2) Prep Credit Packages: clients can buy lessons in bulk, ex: 5-10 packs, but are not charged recurrently. (Clients can be charged recurringly for a prep credit package upon request) 
 

3) A La Carte single lessons. 


4. Group Classes and Services:


● There may be no refunds/pro rates issued for missed group classes.


● There shall be a 48 hour cancellation policy for group classes. Some Group classes may be stated as non refundable.
 

● For headshot sessions, once you RSVP, you HAVE CONFIRMED your slot. You are responsible for payment and no refunds may be given.


● For Reel Clips: Once there is a deposit, you HAVE CONFIRMED your slot. You are responsible for payment and no refunds may be given.


5. Instructor Communication Policy:


●Clients may contact instructors via email or text message; however, instructors are not obligated to respond to text messages. Text messaging should be used for urgent or time-sensitive matters only.


●For all general inquiries, scheduling questions, or non-urgent communication, clients are required to contact the studio and/or instructor via email.


●The studio and its instructors are not responsible for missed or delayed responses to text messages.


6. Self Tapes/ Emergency Audition Prep:


● We have many students who are working professionally in the industry. At times, these students are required to send in self taped auditions the same day as they receive instructions. In such situations, you may be asked to reschedule your lesson to ensure the self tape is delivered on time. We ask for your understanding and cooperation if this happens.

7. Confidentiality:


● The Prep and its representatives agree to hold in strict confidence all confidential information disclosed during the contractual/consulting relationship to protect the privacy of the client/business relationship and its employees to the extent permitted by law.


● The Prep parents/guardians/students agree to not expose, reveal or make public any information in connection with The Prep or these Terms and Conditions, all of which information is to be regarded by the students as of a strictly confidential nature.


● The Prep parents/guardians/students are entitled to privacy and agree to not to approach, entice, solicit, or contact other The Prep parents/guardians/students regarding professional/confidential information. The Prep parents/guardians/students agree to not approach, entice, solicit, or contact The Prep staff/faculty or other The Prep
parents/guardians/students following their leaving of The Prep studio.


8. Supplemental Materials:


● Any supplemental materials needed for lessons - tracks, sheet music, etc. purchased by The Professional Performance Prep is due at the students’ following session. 


9. Miscellaneous:


• Any payment returned for insufficient funds shall be subject to a charge of $50.00. Any invoices for services rendered at The Prep not paid within ten (10) calendar days of notice shall be subject to interest charges of one and one half percent per month, and in no event higher than the interest rate provided by law. If The Prep is required to engage the services of a collection agency or an attorney, the student agrees to reimburse The Prep for any reasonable amounts expended in order to collect the unpaid balance. Students shall be liable to The Prep for any and all damages suffered by The Prep as a result of student’s breach of the terms of this agreement, including, all damages, reasonable attorneys’ fees and costs incurred by The Prep in enforcing the terms herein.


• This Agreement shall be governed by the laws of State of New Jersey. If any provision of this Agreement is declared invalid by any tribunal, the remaining provisions of the Agreement shall not be affected thereby.


• This Agreement sets forth the entire transaction between the parties; any and all prior Agreements, warranties or representations made by either party are superseded by this Agreement. All changes in this Agreement shall be made by a separate document and executed with the same formalities. No agent of The Prep, unless authorized in writing by the management of The Prep, has any authority to waive, alter, or enlarge this contract, or to make any new or substituted or different contracts, representations, or warranties.


• In the event of a dispute, student agrees that any claim for adjustment shall not be reason or cause for failure to make payment in full. In the event that student has a dispute, prior to the commencement of any formal legal proceedings, student shall provide The Prep with a twenty (20) business day written notice of Student’s intention to commence legal proceedings along with an itemized and detailed breakdown of the students concern/dispute (hereinafter referred to as “notice period”.) All claims filed by student shall be filed and resolved through binding arbitration with the American Arbitration Association unless The Prep elects during the notice period to opt out of arbitration. If The Prep fails to opt out during the notice period, then Student shall file all claims or disputes with the American Arbitration Association, said arbitration shall be held in Monmouth or Middlesex County, New Jersey and shall be governed by the Consumer Arbitration Rules. In the event that The Prep opts out of arbitration, Student shall be required to file the complaint in the Superior Court of New Jersey, Monmouth County which shall have exclusive jurisdiction and venue. Student agrees and acknowledges that student waives the right to a Jury trial or to be a participant in a class action lawsuit and that any arbitration or litigation will take place on an individual basis and class actions of any kind are not permitted.


• Student shall provide a good email address and mailing address for notices. It is acknowledged that the email address and mailing address referenced below are good addresses for notice and it may be assumed that said addresses are good addresses unless notified in writing by the student of the same. Student gives permission to receive text messages.
